Top communist leader captured


A top leader of the Communist Party of the Philippines (CPP) was captured by members of the Philippine Army, Cavite police and the Criminal Investigation and Detection Group (CIDG) on Monday night in Bacoor City, Cavite province.

Adelberto Silva was arrested along with his wife, Sharon Ronquillo Cabusao, and Isidro de Lima at 11:10 p.m. in a rented apartment in Barangay (village) Molino 5 by virtue of a warrant of arrest for 15 counts of murder issued by the Regional Trial Court Branch 18 of Hilongos, Leyte.

Silva had been living at his hideout in Bacoor for a year and had posed as a businessman, according to a police report.

Supt. Rommel Estolano, Bacoor police chief, said in the report that Silva was a member of the CPP Central Committee and headed the party’s National Organization Department.

The CIDG, in its Twitter account, identified Silva as the secretary general of the CPP, while a military statement said he was considered the “highest ranking” leader of the CPP and its armed wing, New People’s Army (NPA).

Low profile

Brig. Gen. Joselito Kakilala, the military spokesman, said the low-profile Silva took over the CPP-NPA leadership after the arrest of CPP chair Benito Tiamzon and his wife, Wilma Tiamzon, the party’s secretary general, in Cebu province in March last year.

“He is the overall orchestrator of rebel movements in the entire country. He organizes the activities of the rebels,” Kakilala told Agence France-Presse.

“This (arrest) will have a huge impact. This will disrupt their strategic direction and programs,” he added.

Longest-running rebellion

The CPP and the NPA have been waging war against the government for the past 46 years in what has been considered the world’s longest-running Maoist-inspired rebellion. Talks to end the fighting have stalled.

From a peak of more than 26,000 in the late 1980s, the NPA strength has dwindled to 4,000 fighters, according to the military.

Gen. Gregorio Pio Catapang Jr., the Armed Forces chief of staff, was pleased with the arrests and commended both the military and police teams for the successful joint operation.

“This victory against criminality is attributed to the concerted efforts of the military, Philippine National Police and other stakeholders in our common pursuit for peace. This accomplishment is for the innocent people who are victimized by the NPA’s senseless violence,” he said.

Maintenance medicine

Silva, who is believed to be “in his 60s and was already taking some maintenance medicines,” did not resist arrest, said a police source, who requested anonymity for lack of authority to speak on the case.

“He denied (he was Silva). But we found several IDs that showed pictures of the same person,” said the police source.

Recovered from Silva were three rifle grenades, documents, improvised bomb components and several electronic devices.

The authorities conducted an inventory of the seized items in the presence of village officials.

On Tuesday afternoon, Silva and his two companions underwent inquest proceedings in a court in Bacoor although they will be detained at the PNP headquarters in Camp Crame in Quezon City.

Good intelligence work and a little help from neighbors led to the capture of the highest CPP-NPA leader, said a military source.

The source, who asked not to be named, told the Inquirer that an informant had tipped off the military that Silva was renting a house with his wife in Bacoor.

“With the arrest of the Tiamzon couple in March last year, the military intelligence started working on their possible successor in the CPP-NPA and it was Silva. Immediately, surveillance was conducted, which lasted for six months,” the source said.

Asked about the impact of Silva’s arrest on the CPP-NPA, the source said the CPP organizational structure was in disarray with the capture and death of their top cadres.

Trial for Leyte killings

Silva will stand trial for the murder of 15 people whose remains were recovered from a mass grave in Leyte in 1985, the military said.

Earlier this month, ranking CPP-NPA leaders were arraigned at the Manila Regional Trial Court Branch 47 for 15 counts of murder in connection with the killings in Inopacan, Leyte.

Among those arraigned were the Tiamzon couple, Satur Ocampo, Vicente Ladlad, Randal Echanis and Rafael Baylosis.

The Tiamzons refused to enter pleas at their trial last month for the same killings, so the court entered “not guilty” pleas on their behalf.

The killings in Inopacan were allegedly an attempt by the CPP-NPA to purge its ranks of suspected military “deep penetration agents,” the military said.

The NPA tried suspected military informants using “kangaroo courts,” leading to the summary execution of several suspects, including those from Sapang Dako village in Inopacan town, according to the military.

The communist rebellion has claimed about 40,000 lives by official estimates.

Talks stalled

Peace negotiations have been stalled since 2004, with both parties adamant in pushing for their respective preconditions before the start of the negotiations.

The last breakdown of the talks occurred in February 2013.

Last December, Jose Maria Sison, the CPP founder, said the National Democratic Front of the Philippines (NDFP) and the Philippine government might resume talks probably after Pope Francis’ visit to the Philippines in January.

Sison, who is in exile in the Netherlands, is the chief political consultant of the NDFP, the political arm of the CPP that had been engaged in peace talks with the government.

Teresita Deles, presidential adviser on the peace process, said last December that both parties were amenable to returning to the negotiating table to end more than four decades of communist insurgency.

Since then, nothing has been heard about the resumption of peace talks between the NDFP and the government.

Arrest of communist leader ‘illegal’ – human rights group

HUMAN rights group Karapatan blasted the supposed “illegal” arrest of communist leader Adelberto Silva, claiming that he is a peace consultant of the National Democratic Front of the Philippines negotiating with the government.

In a statement, Karapatan said that the arrest was a “serious violation of the signed agreements between the two parties.”

Silva was arrested last Monday in Bacoor by joint security forces. He was said to have taken over the New People’s Army leadership after the arrest of top leaders Benito and Wilma Tiamzon last year.

Cristina Palabay, Karapatan Secretary General said Silva is a holder of the Joint Agreement on Safety and Immunity Guarantees. He assumed the name of “Percival Rojo.”

Army spokesperson Lt. Col. Noel Detoyato confirmed that Silva had used the name Percival Rojo in one of his identification cards.

Karapatan said Silva is a consultant of Kilusang Mayo Uno and his wife, Rosanna Cabusao, is a researcher/consultant of the Crispin B. Beltran Resource Center and a founding member of Gabriela.

The arrest of Silva “shows how the GPH continues to undermine the peace process by disregarding the JASIG and the Comprehensive Agreement on the Respect for Human Rights and International Humanitarian Law (CARHRIHL) because of the trumped up charges filed against peace consultants,” Palabay said.

There are 16 NDFP consultants arrested and are still detained, Karapatan said.

Armed Forces public affairs office chief Lt. Col. Harold Cabunoc said that Silva is facing criminal cases and it was “surprising” that he is identified as a peace consultant.

They could not prove that they are indeed listed in the JASIG protected personalities as they could not present any evidence to prove his claim,” he said.

The military said Silva has a warrant of arrest for 15 counts of murder. He was also tagged in the Inopacan attack in Leyte, which killed about 400 people in 1985. AC

Ocampo and co-accused argued that skeletal remains in Inopacan were the same bones found in mass grave in Baybay, Leyte in 2000

In a decision dated February 11, the Supreme Court dismissed the consolidated petitions for certiorari filed by the accused and tasked the trial court to determine if the murders were committed in pursuing rebellion. Ocampo and more than 70 others were charged in connection with an alleged mass grave found in Inopacan, Leyte.

In a clarificatory hearing on April 1, Judge Marino dela Cruz Jr. of the Manila Regional Trial Court Branch 22 said the prosecutor in Leyte, referring to Rosulo Vivero, included in the case information that the accused are members of the Communist Party of the Philippines and that they ordered the killing. 

Dela Cruz said should the court determine that the case was done in pursuit of rebellion, then the charges would be dropped and a rebellion case would be filed. The court, he added, would, however, wait for the decision of the Supreme Court on the motion for reconsideration that Ocampo and his co-accused filed before the high court on March 10. 

Ocampo, in his weekly column at the Philippine Star, said “the murder charge is the only remaining court case (all instigated by the state security forces) I have to confront, fight and win. Since 1978 I have confronted eight various charges — but have never been proven guilty of any crime.”

In an interview with Bulatlat.com after the clarificatory hearing, Ocampo said, “it is as if they are inducing us to prove that (we are guilty) of rebellion so we can be charged so. But we do not want that.”


On the same day, however, the Supreme Court upheld its February 11 decision and gave the Manila Trial Court Brach 32 “the go-ahead to proceed with the multiple murder trial of former Bayan Muna Rep. Saturnino Ocampo and three other consultants of the Communist Party of the Philippines – National Democratic Front in connection with the discovery of a mass grave in Inopacan, Leyte some eight years ago,” Interaksyon.com reported

No evidence

In their motion for reconsideration filed before the high court, Ocampo and his co-accused argued that the five of the 12 skeletal remains found in Inopacan, Leyte were the very same found in the alleged mass grave in Baybay, Leyte in 2000.

The petition claimed that public prosecutor Vivero misled the judge and the parties by implying that the identities of the victims have been ascertained through forensic evidence.

Petitioners also found no sufficient evidence for the warrant of arrest issued against the accused.

“The petition stated that Ocampo was detained at the time of the incident. The petition also stated that of the voluminous documents submitted by the complainants as their so-called evidence, the name of Randall Echanis was mentioned only once. The name of Rafael Baylosis, meanwhile, was mentioned by three prosecution witnesses who averred that Baylosis is one of the members of the CPP Central Committee who ordered the alleged mass killings,” a previousBulatlat.com report read.

Ocampo said that at the time that the murder charges were filed there was also an existing rebellion case pending at the Regional Trial Court of Makati.

“They did not subsume it to the rebellion case, which was dismissed in 2007,” he said.

“If the Supreme Court will not decide on our favor, we will still raise the issues before the RTC trial,” Rachel Pastores of the Public Interest Law Center, lawyer for the accused, told Bulatlat.com.

Prosecutor wants Tiamzons in Manila jail

MANILA, Philippines—A government prosecutor involved in the multiple murder case against Benito and Wilma Tiamzon said they should be detained in the Manila City Jail and it was “utter disrespect” on the part of the Philippine National Police to ask the Manila Regional Trial Court for continued custody of the couple without consulting the prosecution.

“(The arresting officers) should have sought conformity, which they never did. We’re on the same side. (The Tiamzons) should be committed to the Manila City Jail, the nearest jail to the court,” said Senior State Prosecutor Peter Ong during a clarificatory court hearing on Tuesday.

Benito and Wilma Tiamzon, chair and chief finance officer, respectively, of the Communist Party of the Philippines, are currently detained in Camp Crame in Quezon City, the national police headquarters. They are coaccused in a multiple murder case in connection with a mass grave discovered by the military in Inopacan, Leyte, in 2006.

The skeletal remains that were found were believed to be those of victims of “Operation Venereal Disease” launched by the Communist Party of the Philippines, New People’s Army and National Democratic Front to purge their ranks of suspected military informers.

Inopacan, Leyte mass grave photos


A mass grave was discovered by elements of the 43rd Infantry Brigade of the Philippine Army in August 2006 at Sitio Mount Sapang Daco, Barangay Kaulisihan, Inopacan, Leyte.

What you will see in the photos are skeletal remains dug out in the infamous killing field in the mountainous part of Inopacan. The site has been referred to as the Garden. The bones were believed to be those of victims of “Operation Venereal Disease” (a.k.a. Oplan Ahos, or Kampanyang Ahos) launched by the Communist Party of the Philippines, New People’s Army and National Democratic Front to purge their ranks of suspected military informers.

While they despised and hated the rule of martial law in the lowland, we the family farmers in the mountain part of Inopacan suffered the atrocities and brutalities of the NPA rebels. The constabulary and later the army soldiers maltreated us also. We have nowhere to stay. The farmers were forced to leave the farm and settled literally within the border of the sea and land in the lowland and became fishermen. 

Then one fateful night, the rebels purged a number of males in our barrio. Some of them were fathers of my playmates. Few were our relatives.

Most of the youths left Inopacan and became house helpers and workers in Metro Manila and they stayed their until now because they have nothing to come back for. The abaca farms industry were wiped out that many believed were intentionally done by saboteur. Every week someone got lost and never came back.

They brought the victims to the forest of Caulisihan, forced them to dig the ground, then blind folded them and shot them in the head. Their bodies were discovered and dug out later in 2006 from the ground dug by the victims in 1980's. The place is now referred to as the Garden.

I hate to retell the story. But must be told again because I hate more if that will happen again.

In August 28, 2006, skeletal remains of innocent victims of Maoist terrorist’s tyranny and violence were dug up in a mass gravesite in a ridge of Mt. Sapang Dako of Inopacan, some 370 meters above sea level, by elements of the Phil. Army’s 802nd Brigade, 8ID supported by residents and former NPA rebels who claimed to have witnessed the mass killings and have since rejoined government. The Inopacan mass murders far outweighs the many OPLANS that the Maoist terrorists ordered and under the supervision of the so-called AHOS committee headed by Jose Ma. Benito and Wilma of CPP-NPA, charged of multiple murder in relation to mass graves in Inopacan

The Department of Justice (DOJ) on Friday filed criminal charges against communist rebel leaders Benito and Wilma Tiamzon and their five companions who were captured in Cebu last week.

In four separate information sheets filed at 8 a.m. at the Cebu City Regional Trial Court, the DOJ accused the Tiamzon couple and their companions of illegal possession of firearms and explosives and obstruction of justice.


Benito and Wilma, chair and finance officer of the  Communist Party of the Philippines, are already wanted for a multiple murder charge before the trial court in Hilongos town, Leyte. The charge is in relation to alleged mass graves in Inopacan town in Leyte purportedly of victims of communist purges in the 1980s.

In the new charges, the Tiamzons and three others— Joel Enano, Arlene Panea and Rex Villaflor—were cited for violating Section 1 of Republic Act No. 9516 (illegal possession of explosive and incendiary devices).

Two fragmentation grenades were allegedly recovered and confiscated from the group after they were arrested on March 22 in a joint police and military checkpoint in Barangay Zaragoza in Aloguinsan town in Cebu, 60 kilometers southwest of Cebu City.


The five were also accused of violating Section 28 (a) of RA 10591 (Comprehensive Firearms and Ammunition Regulation Act) for possession of a .5- cal. Colt pistol and three magazines with 17 rounds of ammunition, and a 9mm Norinco pistol with a magazine loaded with seven rounds of ammunition.


Enano, Panea, Villaflor as well as Nona “Lorraine” Castillo and Jeosi Nepa were separately charged for violating Presidential Decree No. 1829 (obstruction of justice) for allegedly “harboring and concealing” the Tiamzon couple.

The DOJ filed a separate charge against Castillo and Nepa for violating RA 10591 in relation to the recovery of a 9mm Kimber pistol with a magazine loaded with seven rounds of ammunition and a .357-cal. revolver with six rounds of ammunition.

The charges were filed by Assistant State Prosecutor Niven Canlapan and approved by Prosecutor General Claro Arellano.


Lawyers of the accused, however, have claimed the firearms and grenades were “planted” by the arresting team and that only the couple’s pet dogs and a cat were found when the accused were flagged at a checkpoint on board a Hyundai Starex van and Toyota Innova multipurpose vehicle.


But in his seven-page resolution dated March 24, Canlapan found probable cause to file charges against the seven.


He said the .45-cal. pistol, 9mm Norinco, two hand grenades and ammunition were recovered from the Starex van. The 9mm Kimber pistol and .357-cal. revolver and ammunition were found in the Toyota Innova vehicle, according to the DOJ.

Multiple murder raps vs Satur Ocampo, others to push through

The case against former Bayan Muna party-list Rep. Saturnino "Satur" Ocampo and others tagged in the supposed mass purging of members of the Communist Party of the Philippines-New People's Army will continue.

This was after the Supreme Court—in an en banc summer session in Baguio City on Tuesday—denied a motion for reconsideration that sought to reverse its February 11 decision ordering a Manila court to resume hearing the multiple murder case.

"In a minute resolution, the court denied the motion for reconsideration of its decision dated February 11, 2014 filed on March 11, 2014 by counsel for petitioner Vicente P. Ladlad in G. R. 19005 in a minute resolution," said the SC Public Information Office in a statement.

The SC PIO said "no vote (was) indicated" in the resolution.

In its original ruling in February, the high court dismissed the consolidated petitions filed by Ocampo and co-accused Randall Echanis, Rafael Baylosis, and Vicente Ladlad contesting the criminal charges filed against them following the discovery of a mass grave in August 2006.

The high tribunal, however, ruled that Ocampo and the three other petitioners shall continue enjoying temporary liberty until the case is resolved or until their participation as consultants in peace negotiations with the government is terminated.

In his petition, Ocampo invoked the political offense doctrine, which states that a common crime such as murder is absorbed by a political offense like rebellion when the common crime is committed as a "necessary means, in connection with or in furtherance thereof."

In its February ruling, however, the SC said the political offense doctrine was not grounds to dismiss the charges against the petitioners "prior to the determination by the trial court that the murders were committed in furtherance of rebellion."

The high court also ruled that Ocampo and the other petitioners were given due process during the preliminary investigation and in the issuance of the arrest warrants.

Despite the case being non-bailable, Baylosis and Ladlad had earlier asked to be allowed to post bail, saying they were consultants of the National Democratic Front of the Philippines negotiating panel to the peace talks with the Philippine government.

The charges against Ocampo and the others were filed after a mass grave was discovered by elements of the 43rd Infantry Brigade of the Philippine Army in August 2006 at Sitio Mount Sapang Daco, Barangay Kaulisihan, Inopacan, Leyte.

On March 7, 2007, arrest warrants against Ocampo and the other suspects were issued, after the prosecution claimed the bodies in the mass grave were victims of an alleged purge of New People's Army members in 1984 and 1985.

Ocampo has flatly denied the allegations, saying he was in government detention when the incidents occurred.
